Terms of Service

Welcome to HomeKey Detroit. These Terms govern your use of the platform operated by HomeKey Detroit LLC (Michigan LLC, formation pending) ("HomeKey," "we").
By creating an account, posting a listing, applying, messaging, or otherwise using the Service, you agree to these Terms.
1. What HomeKey Is (and Isn't)
HomeKey is a listing and communication platform connecting private landlords with renters. We are a neutral venue. We do NOT:
- Own, manage, or inspect any listed property
- Act as a real estate broker, agent, or landlord
- Verify truthfulness of listings beyond optional ID verification
- Screen renters' credit, criminal history, or rental history
- Collect rent, deposits, or fees on behalf of landlords
- Guarantee any transaction or property condition
- Mediate disputes between landlords and renters
Important: Any agreement, lease, or payment between a landlord and renter is solely between those two parties. HomeKey is not a party to any rental agreement.
2. Eligibility
You must be 18+ and able to enter binding contracts.
3. Landlord Responsibilities
- You own the property or have authorization to advertise it
- All listing information is accurate
- You comply with Fair Housing Act and Michigan anti-discrimination laws
- You will not engage in fraud or unlawful eviction
4. Renter Responsibilities
- Application info is truthful
- You will independently verify property and landlord before paying any deposit
- You will visit the property in person and review the written lease before paying money
Never wire money, send cash, or pay a deposit before: visiting the property, verifying ownership, and signing a written lease.
5. Verified Landlord Badge
The badge means HomeKey reviewed ID and ownership documents at a point in time. It is not a guarantee of current legal standing, character, or property condition.
6. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. HOMEKEY DOES NOT WARRANT THAT LISTINGS ARE ACCURATE, LANDLORDS ARE WHO THEY CLAIM, OR RENTERS WILL PAY RENT.
7. Limitation of Liability — Read Carefully
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMEKEY IS NOT LIABLE FOR:
- Bad deals, bad tenants, or bad landlords
- Loss of rent, deposits, application fees, or money paid between users
- Property damage, theft, vandalism, or unpaid utilities
- Eviction proceedings or related costs
- Fraudulent listings, fake landlords, or scams perpetrated by users
- Personal injury occurring on any listed property
- Discrimination, harassment, or unlawful acts by other users
- Errors in listings, photos, or descriptions
- Lost data, downtime, or technical failures
- Any indirect, incidental, special, consequential, or punitive damages
Total cumulative liability is limited to the greater of $100 USD or amounts you have paid HomeKey in the last 12 months.
8. Indemnification
You agree to indemnify and hold harmless HomeKey Detroit LLC from claims, damages, and costs (including attorneys' fees) arising from your use of the Service, your listings, your interactions with users, or your violation of these Terms or any law.
9. Prohibited Conduct
- Fraudulent, duplicate, or misleading listings
- Discrimination on any protected basis
- Harassment, threats, or intimidation
- Identity theft or other crimes
- Soliciting payments via wire transfer, gift cards, or untraceable methods
10. Governing Law
Michigan law governs. Disputes resolved in Wayne County, Michigan courts.
11. Changes
HomeKey may update these Terms. Continued use after changes is acceptance.
